Terms of Service

• You must be at least 16 years old.
• You must give accurate information and keep your sign-in details private. You are responsible for activity on your account.
• Coaches and gym owners must have the right to offer the coaching or classes they list, and are responsible for the advice they give their clients.

ELYV is a fitness coaching platform: training and nutrition tracking, recovery and readiness insights from devices you connect, AI-generated plans and suggestions, coach-athlete communication, classes, and coach-led circles.

ELYV is in a testing phase. Features may change, move or be removed, and we do not guarantee that the Service will always be available or error-free.

ELYV is a coaching tool, not a medical device. Nothing in ELYV is medical advice, a diagnosis or treatment.

• Recovery, readiness, sleep, calorie and nutrition figures are estimates. Wearable readings can be inaccurate.
• AI-generated plans, briefs and answers can be wrong or unsuitable for you. Use your judgement, and stop if something hurts.
• A coach’s feedback is guidance, not a substitute for a doctor, dietitian, physiotherapist or psychologist.
• Talk to a qualified health professional before starting a new programme, especially if you are pregnant, injured, or have a health condition. In an emergency, call your local emergency number.

• You choose which coaches you connect with. A coach sees your training and profile basics; your recovery and nutrition data only if you switch sharing on.
• You can switch sharing off or remove a coach at any time, and their access ends immediately. Coaches at a gym you belong to keep access to your training until you leave that gym.
• Following a coach’s recommendations is your choice.
• Any agreement about fees or services between you and a coach or gym is between you and them. ELYV is not a party to it.

You agree not to:

• access or try to access another person’s account or data;
• post content that is unlawful, harassing, hateful, sexual, or that infringes someone else’s rights;
• reverse-engineer, scrape, overload or interfere with the Service;
• use ELYV for anything unlawful.

You can report or block another user from their messages. Tell us about unauthorised access to your account straight away.

• You own the data and content you put into ELYV.
• You give us permission to host, process and display it to run the Service for you and for the people you share it with, and to use it in aggregated or de-identified form to improve ELYV.
• How we handle personal and health data is set out in the Privacy Policy.

Wearables and apps you connect (Apple Health, Health Connect, WHOOP, Garmin, Oura, Strava, Fitbit and others) are run by their own companies under their own terms. We are not responsible for their accuracy, availability or changes to their connections.

Paid features, where offered, are processed by our payment provider and shown with their price before you pay. ELYV does not collect coaching fees on a coach's behalf unless it says so clearly.

The Service is provided "as is" and "as available". To the fullest extent the law allows, ELYV is not liable for:

• injuries, health outcomes or results from following plans, AI suggestions or coach advice;
• inaccurate data from wearables, apps or manual entries;
• interruptions, loss of data, or failures of connected services;
• loss caused by someone using your sign-in details;
• indirect or consequential loss.

Nothing in these terms limits liability that cannot be limited by law, or your mandatory rights as a consumer where you live.

• You can delete your account at any time in Settings. Deletion is immediate and cannot be undone.
• We may suspend or close an account that breaks these terms, harms other users, or where the law requires it.

We may update these terms. When a change matters, we will show the new version in the app and ask you to accept it before you continue.

These terms are governed by the laws of the Dubai International Financial Centre. Disputes go to the DIFC Courts, unless the law where you live gives you the right to bring a claim at home. We will always try to resolve a problem with you directly first.
